Fimcap Statutes

Art 1. Name
It is constituted under the name "F.I.M.C.A.P.", an International Catholic Federation of Youth Organisations. The abbreviation F.I.M.C.A.P. comes from the original title : "Fédération International des Mouvements Catholiques d'Action Paroissiale".
Art 2. The Registered Office
The Registered Office is based in Belgium, in Antwerp. It can be transferred to any other place by a simple decision of the General Assembly (G.A.) on proposition of the Bureau.
Art 3. Definition
  • F.I.M.C.A.P. is a federation which gathers in an international scheme the Catholic Youth organisations which do not relate to a specific professional group, but which have accepted as their aim animation of children and young people for activities of total development, in their free time, in a parochial setting, and to build with them a better world and a living Church.
  • F.I.M.C.A.P. recognises and subscribes to the U.N. Human Rights and more particularly to the U.N. declaration of Rights of the Child.
  • F.I.M.C.A.P. expects its members to do the same.
Art 4. Aims
The aims of F.I.M.C.A.P. are more particularly :
  1. to unite the member organisations in a spirit of brotherhood and mutual aid, in order to give their members the awareness of belonging to a world-wide community of youth and the Church.
  2. to promote the Catholic communities of youth, their apostolate and their catechism.
  3. to help to discover and understand the problems and needs specific to children and young people throughout the world; to inquire their deep-rooted causes, and to work out a strategy and actions to be taken.
  4. to give concrete help to the life of member organisations especially by research and pedagogical and methodical exchanges.
  5. to represent the member organisations and defend their interests in international institutions, and support them on national level.
Art 5. Means of action
F.I.M.C.A.P strives to realise its objectives particularly by:
  1. the continual exchange of ideas, of experiments and means of actions between all member organisations.
  2. help and mutual support.
  3. meetings and contacts at all levels.
  4. the study of common problems.
  5. common actions with member organisations and other organisations concerned with children and youth.
  6. organisation of representations or contacts in international instances/bodies.
Art 6. Members, Observers and Guests
Art 6.1. Members
Membership can be granted to organisations of children and young people structured on national or regional level, fulfilling following criteria:
  • agree with the aims of F.I.M.C.A.P. as described in article 4;
  • encourage youngsters - through community life - to develop themselves, to be responsible for themselves, to discover the cultural, social and political realities, to live openness, solidarity, engagement, and to share responsibility;
  • are based on the Gospel in order to promote in general the participation of young people in life and their parochial mission;
  • provide formation of staff and regular information of members and leaders.
The admission or exclusion of members is subject to ratification by the General Assembly (article 9). Applications for membership must arrive at the Secretariat of F.I.M.C.A.P. six months before the G.A.
The organisation which ceases to take part in F.I.M.C.A.P. has no rights over the joint assets.
Art 6.2. Associate members
Inspired by the wish of the Catholic Church to promote the dialogue and the reconciliation of the Christian family, F.I.M.C.A.P. shall be open to Christian non-Catholic organisations.
Organisations can apply for associate member status.
Conditions of admission are the same as for full members. Associate members shall have consultative vote. The number of associate members may not exceed 1/4 of the total number of members.
Art 6.3. Observers
Before an official admission, the federation that wants to know F.I.M.C.A.P. better, can ask the Bureau to become an "observer" and participate at F.I.M.C.A.P. activities. Observers have no right to vote.
Art 6.4. Guests
The Bureau can invite non-member organisations or individual persons to participate in activities that interest them. These persons and federations then get the status of "guest" and have no voting right. The number of guests may not exceed one third of regular participants.
Art 7. Commitments of the member organisations
The member organisations of F.I.M.C.A.P. commit themselves to help realise the aims defined in article 4, and by virtue of this, agree as far as they can to:
  1. take part in the General Assembly and activities agreed in common;
  2. put into effect the decisions taken by General Assembly;
  3. keep in regular contact with the secretariat, inform it of their programmes, activities and undertakings on a national or international level, and communicate their publications;
  4. lend help, either ideological or financial, to the life of F.I.M.C.A.P.;
  5. pay the membership fee fixed by General Assembly.
Art 8. Organs
The organs of F.I.M.C.A.P. are:
  1. The General Assembly
  2. The Presidium
  3. The Bureau
  4. The Continental Conferences.
Art 9. The General Assembly
  1. Composition
    The General Assembly is composed of members of the Bureau and the representatives of the member organisations.
  2. The ordinary General Assembly meets every three years. The General Assembly can meet in an extraordinary session. It will be convened by the Bureau on its own initiative or on proposal of at least 10 member organisations.
  3. Tasks
    The General Assembly can use its full power to realise the aims/objectives of the association. More particularly it is the General Assembly who:
    • elects the chairperson of the elections;
    • elects the President and the General Secretary(ies);
    • elects the treasurer;
    • controls the work of the Bureau and agrees on its report of activities;
    • controls the financial situation and appoints an auditor;
    • studies and determines the direction of F.I.M.C.A.P.'s work;
    • settles the programme of activities for the next term;
    • decides about admission or exclusion of member organisations as proposed by the Bureau;
    • interprets the statutes in their authentic meaning;
    • fixes the statutory membership fee;
    • ratifies the constitution of the Continental Conferences;
    • entrusts the Presidents of the Continental Conferences with the task of Vice-President of F.I.M.C.A.P.
  4. Votes
    The member organisations each have one vote. An absent organisation can give proxy in writing and on particular points to another member organisation appointed to represent it. Nevertheless, a member organisation can not have more than two votes. In order that the vote is valid, at least 10 organisations must be present or represented. At least 1/3 of the organisations present must come from a continent other than the rest.
    1. A 2/3 majority is required for :
      • the admission or the exclusion of member organisations
      • change of statutes
      • all proposals considered important by the General Assembly.
    2. Elections are done by secret ballot with majority of 2/3 of the votes expressed. If no candidate has obtained the 2/3 majority after the second ballot, there is a third ballot with simply majority.
    3. All other decisions are taken by simple majority.
  5. Resolutions
    The resolutions of the General Assembly are communicated to each and every one of the member organisations and to the various instances concerned.
Art 10. The Presidium
Art 10.1. The President or Madam President
The President or Madam President is elected by the General Assembly for three years. The President chairs the meetings of the Bureau and the sessions of the General Assembly, with exception of the elections. He or she can only be elected for two consecutive terms.
Art 10.2. The Ecclesiastical Advisor
The Ecclesiastical Advisor is appointed by the Holy See after presentation of the candidates proposed by the Bureau.
Art 10.3. The Secretary(ies)
The General Secretary(ies) is (are) elected for three years by the General Assembly. He(they) conduct(s) the day-to-day affairs of F.I.M.C.A.P. with the agreement of the other members of the Bureau. He(they) convey(s) to each and every one of the member organisations the decisions taken by the General Assembly and the Bureau.
Art 11. The Bureau
  1. Composition
    The Bureau is composed of the Presidium and the Presidents and the Vice-Presidents of the Continental Conferences, plus one representative from Latin America. The presidents of the Continental Conferences become ex-officio Vice-Presidents of F.I.M.C.A.P. The Bureau can be enlarged by co-opted members. The latter can only speak in an advisory capacity.
  2. Jurisdiction
    • The Bureau has all power of management and administration by authority of the General Assembly. It may delegate daily management to a nominee.
    • In an emergency, the Presidium may take decisions.
    • The Bureau is in particular authorised to:
      • organise and summon the General Assembly;
      • carry out the decisions of the General Assembly;
      • take decisions on day-to-day matters and also any urgent business which may arise between sessions of the General Assembly;
      • receive the request for memberships and submit them to the General Assembly;
      • prepare the elections;
      • accept and recognise "observers" and "guests";
      • investigate the financial resources and approve the financial statement and budget;
      • draw up and amend the Internal Ruling System conforming to the statutes;
      • represent F.I.M.C.A.P. in international bodies;
      • publish a newsletter;
      • ensure the contacts with the Continental Conferences through the Vice-Presidents.
  3. The Bureau meets at least twice a year.
Art 12. The Treasurer
The Treasurer is responsible for the finances of F.I.M.C.A.P. He prepares annually a financial report as well as a projected budget. He is in control of its execution. He is elected by the General Assembly on proposition of the Bureau.
Art 13. The Auditor
The Auditor designated by the General Assembly will verify the finances of F.I.M.C.A.P. annually. The report is transmitted to the Bureau for approval.
Art 14. Dissolution
All proposals having for their object the dissolution of F.I.M.C.A.P. must come from the Bureau or from a quorum of two-thirds of F.I.M.C.A.P. members. The Bureau must communicate to the member organisations, at least three months in advance, the date of the General Assembly which will decide on the proposal. The General Assembly will fix the method of dissolution and liquidation of F.I.M.C.A.P.
